Article 15 of the Arizona Constitution establishes the Arizona Corporation Commission. Only 7 states have constitutionally formed Commissions. Arizona is one of only 13 states with elected Commissioners. In the 37 other states, Commissioners are appointed by either the governor or the legislature.

In most states, the Commission is known as the Public Service Commission or the Public Utility Commission. Arizona's Commission, however, has responsibilities that go beyond traditional public utilities regulation. These additional roles include facilitating the incorporation of businesses and organizations, securities regulation and railroad/pipeline safety. Organization

In November 2000, the voters of Arizona approved a measure, placed on the ballot by the State Legislature, which expanded the size of the Commission from three to five Commissioners. The measure also changed the term of office from one six-year term to a four-year term with the possibility of reelection to one additional (consecutive) four-year term. The initial terms of the two new seats are for two years. In the case of a vacancy, the Governor appoints a Commissioner to serve until the next general election. The Commissioners choose one member from among themselves to serve as Chairman.

The Commissioners have the ultimate responsibility for final decisions on granting or denying rate adjustments, enforcing safety and public service requirements, and approving securities matters.

Executive Director

The Director of the Commission Staff is the Executive Director. The Executive Director serves at the pleasure of the Commissioners, and is responsible to the Commissioners for the day to day operations of all Divisions. Section 40-105, Arizona Revised Statutes, outlines the powers and duties of the Executive Director's position.

Divisions

The Commission staff is organized into six Divisions. Each Division is headed by a Director who reports to the Executive Director.

Administration

The Administration Division plans, coordinates and directs the administrative and fiscal activities necessary to support the Commissioners and all Divisions of the Commission. The Division also provides information to the general public and media on all Commission activities.

Hearings

The Hearings Division exercises the Commission's authority to hold public hearings on matters involving the regulation of public service corporations, the sale of securities and the registration of non-municipal corporations. The Hearings Division is also responsible for the Commission's Docket Control Section.

Utilities

The Arizona Corporation Commission has jurisdiction over the quality of service and rates charged by public service utilities. By state law, public service utilities are regulated monopolies given the opportunity to earn a fair and reasonable return on their investments. What is fair and reasonable in any particular case has been and always will be open to debate in rate hearings before the Commission. Generally, the Commission tries to balance the customers' interest in affordable and reliable utility service with the utility's interest in earning a fair profit.

The Utilities Division makes specific recommendations to the Commissioners to assist them in reaching decisions regarding public utility rates, utility finance and quality of service. The Division is responsible for researching and developing utility issues, providing information and evidence in Commission proceedings dealing with utility applications, and monitoring the quality of utility service, and the rates approved by the Commissioners. Additionally, Division staff inspects gas pipelines for safety, operates a railroad safety program and maintains the official documents of proceedings before the

Commission

All rate changes require approval of the Commission in an Open Meeting. Staff preparation for a major rate hearing begins at the time of utility's initial filing, and takes approximately four to six months before the hearing takes place. Work efforts between the time of filing and hearing include a review of past Commission actions, a review of documents on file with the Commission, an audit of the books and records of the utility, discussions with utility personnel and other interested parties, formulation of the staff recommendation, an analysis of the impacts of the recommendation, and preparation of written testimony and schedules.

Securities

The Securities Division strives to ensure the integrity of the securities marketplace through investigative actions as well as the registration and/or oversight of securities, securities dealers and brokers, investment advisers and their representatives; to enhance legitimate capital formation; and to minimize the burden and expense of regulatory compliance by legitimate business.

The Division reviews prospective offerings of securities to ascertain that full and fair disclosure is made to potential securities investors and that the terms of offerings are not inherently fraudulent.

Certain securities dealers, salespersons, investment advisers, and investment adviser representatives are required to register with the Division. The Division reviews these applications and monitors the conduct of investment advisers, dealers and salespersons; investigates possible violations; and when the evidence warrants, initiates administrative or civil actions, or refers cases for criminal prosecution.

Corporations

The Corporations Division approves for filing all articles of incorporation for Arizona businesses; all articles of organization for limited liability companies; grants authority to foreign corporations to transact business in this state; propounds interrogatories when necessary to determine a company's lawful purpose; and revokes the corporate charters of those corporations which choose to not comply with Arizona law. The Division collects from every corporation an annual report which reflects its current status, business, and financial condition; maintains this information in a format conducive to public access; responds to public questions concerning Arizona businesses and corporation law; and responds to the needs of the business sector by disseminating whatever information is mission-critical to them in the most expedient and cost-effective manner possible.

Any significant changes to Articles of Incorporation or Articles of Organization for Limited Liability Companies in the form of amendments, mergers, consolidations, dissolutions or withdrawals are also filed with the Division. All filings are public record and available for inspection.

Legal

The Legal Division provides legal assistance, advice and representation to the Commissioners and each Division of the Corporation Commission except the Securities Division. Matters handled by the Legal Division fall into five general categories: Commission dockets, Federal regulatory dockets, litigation, other administrative matters and special projects.

Most of the Division's resources are devoted to Commission hearings. Major rate cases, such as those involving firms like the Arizona Public Service Company and Qwest, where tens of millions of dollars in potential rate increases are at stake, take several months to prepare and require close coordination with the Commissioners, staff and professional consultants.

Information Technology

The mission of the Information Technology (IT) Division is to provide accurate, efficient and timely technology design, development, implementation, communications and maintenance support services to the agency and its respective divisions in support of their missions and objectives.

Mike Gleason was born in Iowa, where he lived on a farm before joining the United States Navy during World War II. I'm sure you have placed an ad or two in the free classifieds before today but ... did you do it the right way? Are you using spam to help boost your website traffic?

1. OK, let me explain

Free classified ad sites are easy enough to find, simply go to any search engine and put in "free classifieds" and place your ad in as many sites as you like.

Most classifieds ask you to put in your email address for responses. Don't use your normal address, get an auto-responder.

Use the auto-responder address in your ad. Your auto-responder instantly sends out your pre-imputed message to those requiring more information.

2. But what else happens to your ad?

Basically two things; responses from interested persons and spam from spammers. The advantage of an auto-responder is this: From your free classified ads your auto-responder address will most likely be harvested onto spam lists by email gathering software. Which is a good thing!?

Now every time someone spams your auto-responder address they will get your auto-responder message advertising your website, opportunity etc. Spam lists in turn get on other spam lists that eventually get sold to real people using real addresses believing them to be opt in lists.

If you get sick of the spam mail being redirected to you by your auto-responder, you can have your auto-responder messages directed to a dead address.

3. Dealing with classifieds

Now let's say you've decided to put in five classifieds a day. The veteran or dependents need to also submit a copy of their letter of acceptance from the Admissions Office to the certified veteran official for benefits.

Finally, if veterans or dependents have attended a university or college previously, these transcripts should also be submitted to the VA official. As a former member of the military you have ten years from the date of leaving the military to use your military benefits.

Once all these documents are submitted to your certified veterans official, new enrollees can began receiving benefits within sixty to ninety days.

Color Terms You Need To Know When Decorating

Color is the key to successful decorating. You can have the most expensive furnishings you can find, but without the right color scheme, they mean nothing. Color can work magic in a room by taking disparate furnishings and uniting them with color.

The human eye can perceive approximately 10 million different colors. Just imagine all of the different color combinations that can be created. Even so, some color combinations are definitely better than others.

When looking at colors, there are eleven different terms that you should know:

1. Primary colors are the three main colors that every other color is made from: red, blue and yellow. Primary colors are often used in children's rooms because they are bright and will catch a child's attention.

2. Secondary colors are the colors that are created when you combine equal parts of the three primary colors. The color orange comes from red and yellow; green is from yellow and blue; and violet is from blue and red.

3. Tertiary colors are the result of combining a primary color with the nearest secondary color to it on the color wheel. The colors would appear as blue-green, yellow-green, yellow-orange, red-purple, and blue-purple.

4. Related color schemes result from combining secondary and tertiary colors. For instance, the colors blue-green and green will evoke a calming effect because there are no jarring changes in color.

5. Complementary colors are located directly opposite each other on the color wheel. They would turn gray when they are mixed together in paint, but they can be used together - carefully - when decorating a room. Sometimes these color combinations can be too overwhelming so care is needed when using them.

6. Hue is a descriptive word for color, such as leaf green, robin's egg blue or burgundy.

7. Saturation means how saturated (how much color) there is in the basic color. For example, light blue and navy are both still blue. Navy is more saturated with the blue color.

8. The value of a color is how light or dark a color is. White has the brightest value and black has the darkest value.

9. Tints represent the colors that are closest to white in value. These would be pastel colors.

10. Shades are the colors that are closest to black in color, like hunter green or deep purple.

11. Neutrals are the "non" colors, like black, white, gray, brown and beige. They can produce a pleasing color scheme on their own or mixed with other colors.

Find The Hidden Treasure

If you find the hidden treasure when you are talking to a potential client, you will dramatically increase your chances of gaining a client. What on earth do I mean by that? This hidden treasure sounds so mysterious.

I would go so far as to say that the majority of people selling never ever find this treasure. In fact, the majority do not even go looking for this treasure. They don't even know it exists and they have no idea how "golden" it is.

The hidden treasure is the "reason why." It is the reason why your potential client wants their problem solved (desire fulfilled) and the reason why they want it solved now. The real reason why is not initially obvious and requires you to go digging for it.

You go digging for the hidden treasure - the reason why - by asking questions. You will probably have to ask several questions to find it. Your potential client may not even know their reason why until you ask questions to uncover it.

Just suppose you sold a weight loss program, and Mrs. Smith contacts you and says she wants to lose weight and is interested in your program. It would be VERY tempting to immediately start telling Mrs. Smith all about your program and the price. Mrs. Smith would probably say thank you for the information and then ring up your competition and ask them about their program and their price too. Why shouldn't she? Wouldn't you?

In fact, telling Mrs. Smith about your weight loss program is what most (90%+) people would do. After all, that is what Mrs. Smith said she is interested in. Yes, but.

Yes, Mrs. Smith is interested in a weight loss program but WHY? What is Mrs. Smith's reason why?

If you go looking for Mrs. Smith's reason why - the hidden treasure - you will not only increase your chances of gaining Mrs. Smith as a client, but you might find more treasure. Let me show you what I mean by continuing with this example.

Suppose that instead of telling Mrs. Smith about your weight loss program, you instead ask: "Mrs. Smith, why is it important for you to lose weight right now? It may well take a few more questions, as Mrs. Smith may not have thought this through, but then Mrs. Smith finally explains that her daughter is getting married in six weeks time and she wants to look great for the wedding photos.

Although Mrs. Smith said she wanted to lose weight, what she really wanted was to look great for the wedding photos. Losing weight is just the vehicle/solution Mrs. Smith has focused on for looking great in the photos.

Now that you have uncovered Mrs. Smith's reason why - the hidden treasure - you can now tailor a solution to meet Mrs. Smith's reason why she needs your program.

I mentioned before that when you find the hidden treasure, you might even find more treasure as well. By tailoring a solution for Mrs. Smith to look great for the wedding photos - you now open up all sorts of other possibilities. Originally it was all about weight loss but weight loss may now only be part of the solution. Your solution could include other services that you offer or that your associates offer, i.e., an exercise program, a stress reduction program, hair styling and makeup, etc.

So by finding the hidden treasure - the reason why - you are able to give Mrs. Smith what she really wants (and it wasn't weight loss). And it could be a lot more than what she previously asked for.

What if there is no hidden treasure to be found? The beauty of going in search of the hidden treasure is that if you can't find it, then chances are the person you're talking with would never become your client at this point in time anyway. So the sooner you can determine this the better it is for both of you.

The example with Mrs. Smith was a simple example but I guarantee that you can apply this principle with your own clients. Go in search of their reasons why. You may well uncover that you can help them in far more ways than both of you thought possible. Plus, if you go in search of the hidden treasure, you will build an even stronger relationship with your clients.

Can potential new customers really find your company and products on the web?

Imagine that you are one of your own target customers, and that you haven't heard of your company yet. You decide to search the web to look for companies that provide the products or services that your company offers.

Think of one short phrase that you would type into a search engine to find your company (not your company name). Now, using this same phrase, go see if you can find your company in the major search engines. Make sure you try each of the most popular search engines, as ranked by the usage statistics:

Google 32%
Yahoo 25%
AOL (including Netscape) 19%
MSN 15%
Others 9%

Now go to each of these sites and type in "Marketing Consultant Silicon Valley" and see if you find The 280 Group.

Ergonomics At Work Osha Is On The Job

The French poet Charles Baudelaire observed back in the 1800s, Inspiration comes of working every day. Most people do work every day, and unfortunately its not only inspiration that comes of it. Repetitive stress injuries (RSI) are also the result of every day tasks performed again and again while operating a computer. Relief is in sight, however, thanks in part to a particular government agency. This organization is raising awareness and promoting solutions 24/7.

The Occupational Safety and Health Administration (OSHA) has a mandate to protect employees from being hurt in the workplace. James Hodgson, Secretary of Labor, established OSHA within his department in 1971. This was in response to the Occupational Safety and Health Act, legislation he helped author. For the first time in U.S. history, the government stepped in to make sure that workers were as protected as possible from illness, injury, and death on the job. And OSHA had its work cut out for it. Construction, chemical, and agricultural workers were among the many who needed better safety standards in their industries.

But as computer use rose, and the related RSI grew, OSHA turned its attention to this new problem. In recent years, OSHA has developed a four part program designed to reduce injuries and illnesses associated with computer use on the job. The four parts are

Guidelines, Outreach and Assistance, Enforcement, and the National Advisory Committee.

Guidelines are recommended practices that are developed for specific tasks and industries. These are voluntary, not mandatory. Employers use the guidelines to identify and modify risks in the workplace. Implementing these practices reduces injuries related to the way people do their jobs.

The Outreach and Assistance component of this program is aimed at businesses of all sizes. OSHA wants companies to take a proactive stance when it comes to preventing RSI. To help employers, OSHA designed an extensive array of tools that educate, analyze, and train people regarding the ergonomics of their jobs. Available to the public for free on the OSHA website, the computer workstation portion of the Ergonomics eTools is a comprehensive guide to proper computing techniques.

Included in this section is:

Good Working Position (talks about every part of the body and what the best placement is for preventing RSI)

Workstation Components (all the technology and furniture you commonly use is listed here with possible hazards, solutions, and tips)

Checklist (a great way to evaluate how youre doing ergonomically while you operate a computer)

Work Process (focuses on the physical movements of computer use, with hazards to watch for, more solutions, and tips)

Workstation Environment (information about factors people often dont think about such as lighting, ventilation, and glare)

But Outreach and Assistance is more than the Ergonomic eTools. It has industry guidelines, cooperative programs, ergonomic analysis info, and success stories. It even has a checklist with tips for new purchases. It is chock full of valuable information for everyone from the individual computer user to the captains of industry.

How to Launch Your "Boomerang Kidult"

Now that Labor Day has come and gone, all the kids should be out of the house and back at school. But wait! What about your emerging adult child who is still living with you, his or her college degree neatly tucked away? Are you in the midst of a replay of the big screen comedy Failure to Launch and not finding it quite so funny? You're not alone.

Millions of fledgling adults, often called kidults, have graduated from college but are not living independently of their parents. According to the 2000 U.S. Census, 25% of young adults between the ages of 18 and 34 still lived with their parents. Young people are studying longer or marrying later, postponing adulthood until around age 30. Here's how this extended period of dependency can affect relationships.

Steve remembers how he longed for those empty-nester days once his son had moved home from college. He reflected on the irony. The guidelines our son wanted to discuss were not the ones my wife and I had set down. He told us we were not to tie up the computer or play with his dog. He also wanted us to leave the bathroom fan off when we showered, so the noise wouldnt wake him up. We hardly got a chance to talk about what we wanted.

It's called triangulation, when your relationship as a couple has to accommodate your emerging adult child. What it often means is less privacy and spontaneity for you, and a need to establish new patterns of interaction and parenting.

As Beth realized: We cant treat her as if shes a teenager but we also dont intend to lose sleep worrying about whether shes o.k. Unless we can agree on some reasonable curfew, this living arrangement just isnt going to work.

Jill had been a single mom since her three children were young teens. Once her last child went to college she felt free to move in with her partner. When my middle daughter lost her job and could no longer afford to live alone, I didnt have the heart to say no to her. But with the chaos that ensued, I soon regretted my decision. As I recognized that my growing resentment was affecting all of us, I took a stand. We defined the house rules, split up the chores and set a deadline for her moving out. Now we try to openly air the issues and our feelings.

Like Jill, you can take a stand. Here are some more ideas:

1. Establish areas of accountability and appropriate boundaries. This can smooth day-to-day living; it encourages some emotional detachment and the freedom to reclaim your own lives.

2. Insist that your kidults face their own challenges. At times tough love is the most effective support parents can give. Janes son chose to move back home after his divorce and expected his mother to handle his laundry, shopping and cleaning the way his wife had. She knew he had to learn to take care of himself, once again. I insisted that we set some things straight and that he take responsibility for himself. We created a chart like the one when the kids were in grade school. I have not backed down and so far we are all still here, trying to make our complicated situation work.

3. Create a timetable for financial independence. Financial assistance comes with a price for all - with potential conflict around issues of co- dependency, control and unsolicited advice. Jack commented, Our daughter wants to live rent free but wont listen to our advice about how to get back on her feet. Our plan is that she will be on her own within six months, and we will stick to that.

4. Commit to a concrete plan to move the family toward common goals. This requires the willingness to work as a team, with frequent discussions as well as some compromise. When you put limits and deadlines into place, the result is less conflict. According to a 2006 Money/ICR poll, 60% of Americans believe that college graduates should be allowed to move back home, but only for up to a year, and 57% state that parents should charge them rent.

5. Find the right balance between offering support to your offspring and taking care of yourselves. Sally and Garry were enjoying spending time together when the last of their children left home. These pleasures were short lived. When their daughter separated and wanted to move back, they initially felt that they couldnt turn her away. It wasnt long before their patience wore thin, and they knew they had no choice. Our daughter got lazy. She wouldnt look for work and made little effort to help out. We eventually insisted that she find other arrangements. We felt guilty and spent a lot of time discussing our decision. But we have waited forever for this period in our lives and we dont plan to miss it.

6. Let go. Once you have done all you can to prepare your boomerang kidults to be on their own, let go of your resistance and act. Launching them is an opportunity for all of you. Tap into your own passions and begin to imagine the adventures that lie ahead.

Everybody is familiar with 9-1-1 service, which allows you to easily contact emergency services from your home phone. But what about your cell? Emergencies can happen when you're away from home. And even while you're at home, more households are moving towards a single-line solution, replacing their landline phones with mobile.

The FCC requires all cellular carriers to put through all 9-1-1 calls, even when the phone does not have an active service contract. Individuals who have medical conditions may do well to carry an emergency cell phone, even if they do not use a cell phone on a regular basis. It is also an ideal solution for the elderly, who may be at risk while out and about. Keeping an emergency cell phone in the car's glove compartment, along with a portable charger, can help avert a disaster in case of a breakdown or accident in a remote area.

The so-called E911 (enhanced 911) service, mandated by the FCC, also requires carriers to implement a system that tells emergency dispatchers the location of the caller. This has been a part of landline emergency services for several years, and when you call 9-1-1 from your home phone, the dispatcher automatically knows your callback number and your fixed location. But on a mobile phone, there are some technological challenges. Fortunately, the cell phone companies stepped up to the plate and came up with a solution. In Phase I of the FCC mandate, carriers had to create a system that would tell dispatchers the cell phone number of the caller, as well as the location of the cell tower, which would provide at least an approximate geographic location. More sophisticated location detection technology uses GPS-enabled cell phones to determine the location of the caller in an emergency.

Phase II, scheduled to be fully implemented by the end of 2005, goes a step further by providing Automatic Location Identification (ALI), with precise latitude and longitude of the caller, to the emergency dispatcher. This capability has been incorporated into many newer cell phones, but there are still older cell phones still in use. If you plan to use your cell phone as an emergency backup, make sure you have a newer "location-sensitive" phone that is equipped to handle this service.

There is no charge for calling 9-1-1 from a cell phone; the E911 infrastructure is paid for with a small surcharge on normal cell phone services.
